Who we are and what these terms cover

This website is operated by Sergio Anibal Toro Castaño, a self-employed professional with Spanish tax ID (NIF) 45129727R, registered address at Ronda de Queralt 11, 2-2, Avià (Barcelona), Spain, phone 697286134 and email sergio.toro.castano@gmail.com, trading as Escola Catalana de Parapent (Catalan Paragliding School).

These terms govern purchases of services and products through escolaparapent.cat. By ticking the acceptance box during checkout you confirm that you have read and accepted them.

The contract is governed by Spanish law, in particular Royal Legislative Decree 1/2007 (the Spanish General Consumer Protection Act) and Law 34/2002 on information society services and e-commerce (LSSI-CE).

Products and how to buy

Through the website you can buy tandem paragliding flights (at a weekday rate and a weekend or public holiday rate), pilot courses, guided cross-country outings, the community membership (a recurring subscription), gift vouchers and paragliding equipment (harnesses, wings, reserve parachutes and accessories).

The purchase process works like this: you add products to the basket, give us a contact email and phone number, review the order with its total before paying (you can correct any mistakes before confirming), pay through the payment gateway and receive a confirmation email.

We keep an electronic record of your purchase: you receive a copy with the confirmation email and, if you have an account, you can review your bookings from your account. These terms remain permanently accessible on this page.

The contract can be concluded in Catalan, Spanish or English.

The community membership renews automatically for the period you chose. You can cancel it at any time from your account, and the cancellation takes effect at the end of the current period.

Transport from Barcelona is a request, not a purchase: the price is agreed by phone and is not charged online.

Prices and payment

All prices are shown in euros (EUR), taxes included.

Payment is by card through a secure payment gateway (currently Stripe, with PAYCOMET being added). The website never sees or stores your card number. The charge on your statement appears under the school's name.

Bookings, weather and rescheduling

Dated bookings are made at least 72 hours in advance and up to 12 months ahead. If you choose the open-date option, you pay a single handling fee per booking and have 12 months to fly. Premium flights (cross-country and hike & fly) are not scheduled at purchase: we call you to agree on a day depending on the weather, with no extra fee.

Paragliding depends on the weather. For safety reasons the school may postpone or cancel the activity at any time, even at the take-off site on the day itself. The decision always rests with the pilot or instructor.

If the school cancels for weather or any other safety reason, you choose between rescheduling at no cost (with an extension of your voucher's validity if needed) or a full refund of everything you paid.

We confirm the forecast 24-48 hours before the activity. The take-off time and location may be adjusted to the conditions.

Participant requirements

Safety is a shared responsibility. The school may decline to run the activity if your condition compromises safety: in that case the same rules as a school cancellation apply (reschedule or refund), unless you withheld relevant information.

When you take part in an activity, we ask you to:

• Meet the requirements listed on each activity's page.
• Follow the pilot's or instructor's instructions at all times.
• Tell us about any relevant medical condition before the activity.
• If you are a minor, bring a signed authorisation from your parent or legal guardian.

Gift vouchers

Gift vouchers are valid for 12 months from the date of purchase. If the weather prevents flying within that period, we extend the validity at no cost.

If the voucher expires before the activity could take place, write to us: you can ask for an extension or put the amount paid towards another school activity.

Vouchers are issued in the recipient's name but can be transferred to someone else by letting the school know.

Right of withdrawal

The right of withdrawal is governed by articles 102 to 108 of Royal Legislative Decree 1/2007, under Spanish consumer law. Depending on what you buy, one of these regimes applies:

Activities with a booked date or period (a flight or a course with a set date): there is no right of withdrawal, under the exception in article 103.l for leisure activities with a specific performance date. We tell you this expressly before payment. This does not affect the weather policy in the bookings section, which applies in all cases.

Gift vouchers and open-date purchases: you have 14 calendar days from purchase to withdraw without giving any reason and get the full amount back. Premium flights (cross-country and hike & fly), which are bought without a date, follow this same regime until we agree on the day. Once you set a date for the activity, the previous regime takes over and the right of withdrawal lapses; we remind you of this when you book.

Physical equipment: you have 14 calendar days from delivery. The direct cost of returning the goods is yours. You may examine the equipment as you would in a shop; if you go further (for example flying a wing, using a harness or opening a sealed reserve parachute), you are liable for the loss in value, which is deducted from the refund and which for safety equipment can be substantial, because used safety equipment cannot be resold as new. In the case of a reserve parachute delivered sealed, unsealing it can mean a loss in value of almost the entire price, because an unsealed reserve parachute no longer counts as new.

Community membership: you have 14 calendar days from signing up to withdraw without giving any reason. If you asked for the service to start right away, we deduct the part proportional to the time already enjoyed (article 108.3).

If you withdraw, we refund you within 14 calendar days of receiving your notice, using the same payment method. For equipment, we may withhold the refund until we receive the goods or you send us proof of shipment.

Withdrawal form

To withdraw you can use this model form, adapted from Annex B of Royal Legislative Decree 1/2007. It is not compulsory: any unequivocal statement sent to sergio.toro.castano@gmail.com is enough.

Equipment shipping policy

We ship equipment by courier within Spain. For other destinations, ask us before buying.

In-stock equipment is delivered within 3-7 working days. Out-of-stock or made-to-order equipment depends on the distributor's or manufacturer's lead time: check with us before placing the order. In any case, the maximum legal delivery period is 30 calendar days unless we agree otherwise.

Any shipping costs are always communicated before payment.

We recommend checking the package on delivery and reporting any transport damage as soon as possible to sergio.toro.castano@gmail.com.

Equipment warranty

New equipment carries the 3-year legal conformity warranty established by Spanish Royal Decree-law 7/2021. To make a claim, write to sergio.toro.castano@gmail.com.

Cancellations by the customer

If you cannot make it on your booked day, let us know as soon as you can. If you give us at least 72 hours' notice, we reschedule the activity at no cost.

With less than 72 hours' notice, the amount is kept as credit to rebook the activity within the following 12 months. Only if you fail to show up without telling us can the amount paid be lost. Talk to us: we always look for a way to get you flying.

Liability and insurance

Paragliding carries inherent risks that cannot be fully eliminated. The school operates as an organiser of physical and sporting activities in the natural environment under Catalonia's active tourism regulations, and holds civil liability and accident insurance as required by current law. Policy conditions are available on request.

Governing law and jurisdiction

These terms are governed by Spanish law. If you buy as a consumer, any dispute will be heard by the courts of your place of residence.
